The San Diego County Board of Education Joint Powers Authority
shields its panel of approved defense attorneys from legal
responsibility when they violate the law on behalf of school
districts.  This has resulted in legal problems and increased
payments to lawyers.
By stopping its very expensive policy of covering-up wrongdoing.  
SDCOE JPA does not even have a written contract with its
favorite lawyer,
Daniel Shinoff.

More...about the indemnification of the lawyers for SDCOE,
also Randall Winet, and his brother Rick Winet.
Superintendent Randy Ward and assistant superintendent Lora
Duzyk appear to take orders from Dan Shinoff and Diane
Crosier, who don't want to reveal how much the SDCOE-JPA
pays to lawyers.  They all claim that attorney-client privilege
protects that information!

They will get probably away with this until someone takes
them to court over it.
The San Diego Union Tribune did, however, vehemently criticize
the practice of indemnifying public entity lawyers when Otay
Water District was sued by a citizen.  

The water district was defended by the same lawyers that
CVESD had to defend:
Stutz, Artiano, Shinoff & Holtz.

SDCOE lawyers are often hired to advise officials on how to get
away with breaking the law, not on how to follow it.  And who is
responsible for supervising Crosier and her stable of lawyers?  
Diane Crosier's current boss at SDCOE is
Lora L. Duzyk;
previously, it was Dr. Don Shelton.  (Duzyk and Shelton will be
chosen as board members for Mission Federal Credit
Union--MFCU--on May 29, 2008.)
SDCOE-JPA and its member districts have left no paper trail
regarding their use of taxpayer dollars to defend lawyers who
break the law--except at the San Diego County courthouse.   
But who goes to the courthouse to look at the files?  Not the
San Diego press!
One big reason San Diego schools have so many problems is that
the County Board of Education has an improper relationship with  
legal corporations which care nothing about our children.

Superintendent Randy Ward deserves credit for coming up with
a solution to the problem of how to get good teachers to go to
the worst schools.  When he was working for Oakland schools,
he came up with a funding plan in which poor schools could
choose to use their funds to pay for higher-salaried teachers.

CVESD (Chula Vista Elementary School District) recently defended
its own lawyers.  If you paid a lawyer a huge amount of money to
defend you, and he violated the law, would you pay even more to
defend him?  Not likely--unless you had ASKED him to violate the
law on your behalf.  Also, if it wasn't your own money you were
spending, it would be easier to throw good money after bad.  
CVESD board members and administrators were not using their
own money.  They were using the taxpayers' money.

How could San Diego County
Office of Education save
millions of dollars?
Taxpayers have to pay lawyers to keep the truth hidden, and,
since every dollar spent on hiding the truth encourages more
wrongdoing, the costs continue to escalate.

Education dollars should go to kids, teachers and schools--not
lawyers!
If she  really cared about taxpayers, she wouldn't practice
lawsuit abuse herself.  Diane Crosier is one of the primary
abusers of the San Diego County Courts, prolonging for years
lawsuits that should have been settled out of court.  She
believes that schools should have no accountability when they
violate the law against children of taxpayers and employees.
Taxpayers have to pay lawyers to keep the truth hidden, and,
since every dollar spent on hiding the truth encourages more
wrongdoing, the costs continue to escalate.
On Thursday, November 08,
2007 Stutz law firm didn't

produce a single requested
document at its deposition
today.  Ray Artiano
appeared on behalf of Stutz
law firm for the deposition,
but Daniel Shinoff refused
to be deposed. They pulled
off their microphones and
walked out  after I said I
would apologize, take down
my website, and pay them
for any financial harm
IF
my statements about them
proved to be false.  I asked
them to give me some
reason to doubt the truth
of my statements.  I
pointed out that their
refusal to produce
documents and to answer
questions just made them
seem guiltier than ever.

I guess silence was their
defense plan. But if you're
going to file a lawsuit for
defamation, you've got to
be ready to talk about the
statements you find
offensive. It appears that
Stutz' lawsuit was filed
purely for purposes of
intimidation, and is nothing
but malicious prosecution.

Produce those documents,
Dan and Ray, if you want to
stop looking guilty as
charged.
The author is surprised to
learn that she is so
powerful.  
She had believed that no
one was paying attention,
and will be interested to
hear exactly how much
business Stutz has lost on
her account.

The huge irony here is that Diane Crosier, director of the
SDCOE JPA,  who keeps tax dollars flowing to her lawyer
friends, has worked with CALA, Californians Against Lawsuit
Abuse!

superintendent Rudy Castruita 's policy of allowing Stutz law
firm to handle public records requests about Stutz law firm.  
Naturally, Stutz refuses to turn over requested information.  
Also, the notorious law firm
Lozano Smith is still on the
approved list of SDCOE attorneys for school districts to hire.  
Both Rudy Castruita (who retired June 30, 2006) and Randall
Ward  refuse to discuss this problem.

On October 30, 2009 Judge Judith Hayes ordered that information be removed from this
website--
when she wasn't even asked to do so by a litigant!  

Even stranger, Judge Hayes kept the ruling under wraps even after it had become final.  I went
down to the courthouse on November 5, 2009 to get a copy of the order.  I discovered that I had
won the decision, but that the judge, without putting any explanation in writing, had at the same
time ordered that my website be censored.  

I was not given a copy of the ruling when I appeared for the hearing on October 30, 2009.

The ruling concerned a Motion to Strike my answer to a lawsuit, an answer that I filed two years
ago.  Strangely, a summary judgment had already been issued against me.  So why did my
opponents want a default?  Wasn't it enough that the judge based her decision on the
declaration of a man who refused to be deposed or turn over documents, and threw out my
declaration even though I underwent a 6-hour deposition and turned over hundreds of
documents?  

I suppose the advantage of a default would be that my opponents could collect damages
without having the jury trial that I insisted on.

Stay tuned for more of this bizarre saga--unless I am thrown into jail by Judge Hayes.  I wonder
if the mainstream media would cover this case if that happened?

Instead of posting this ruling on the courthouse website with all the other tentative rulings, Judge
Judith Hayes posted a message that said: "The court elects not to post a tentative ruling on this
motion."
