#3 "Misusing the suffering of his wife's relatives to gain an advantage in the courtroom" does not imply unprofessional conduct. It doesn't imply that Shinoff misrepresented anything, either. It is a criticism of Shinoff's lack of delicacy and respect. Using suffering to gain an advantage in court is an acceptable practice, and not unethical. I agree that the second sentence is very close to the statements that were ruled upon, and I have removed it. (Is this a public record?)
Response to demand #2: "Planning legal tactics against parent who complain" is exactly what schools ask Shinoff to do. It's his job to plan those legal tactics. It is silly for Shinoff's law firm, or this court, to claim that planning those tactics is intimidation, unethical and unprofessional." Clearly, defendant has fully complied with the court's order, but I ask Judge Hayes to clarify if "planning legal tactics against parents who complain that their kids aren't getting the right education" is the same as "destroying the lives" of those parents.
#4 This sentence is about a completely separate incident. Does the court find that Shinoff was intimidating, unethical and unprofessional when he sued Dr. B.J. Freeman on behalf of Vista Unifed School District?
